Guidance for Licensees
Licensees will be aware that under the Act they will need a Premises Licence or a Club Premises Certificate and, in most cases, a Personal Licence.
It is important to recognise that the promotion of the licensing objectives relies heavily on a partnership between the applicants for licences, authorised persons, interested parties and responsible authorities in pursuit of common aims. This is emphasised in the Guidance, eg in paragraphs 5.103, 7.3 and 13.4. The Council will therefore encourage, and do all things possible to facilitate, negotiation, agreement & compromise between applicants and people/organisations making relevant representations so that all sides can be happy with (or at least accept) the resolution.
All new premises and all premises seeking a variation will need to submit an Operating Schedule that will form the basis of the conditions attached to the licence.
In preparing their Operating Schedule applicants will be expected to liaise, before submitting their application, with the Licensing Authority & Responsible Authorities. Again this is emphasised in the Guidance, eg at paragraphs 5.47, 5.67, 7.5, 7.15, 7.35 and 7.64.
Applicants may wish (and the Council would encourage) to use the Operating Schedule as a general guide for the Designated Premises Supervisor and the staff and include matters that will not be included as conditions to the licence.
