Review of licensing policy

Lancaster City Council has published a revised version of its Statement of Licensing Policy.

Lancaster City Council has published a revised version of its Statement of Licensing Policy.

It follows widespread consultation with organisations and individuals who have an interest in premises' licensing and experience gained since the implementation of the Licensing Act 2003.

The policy, which will be in effect until 2011, can be viewed on the Licensing section of the council's website.

It was produced in accordance with the Licensing Act 2003, which requires local authorities to review their policies every three years, and contains details of how the council will deal with licensing applications in terms of:

  • The Prevention of Crime and Disorder
  • Public Safety
  • The Prevention of Public Nuisance
  • The Protection of Children from harm

These four objectives are the only matters that may be taken into account in considering an application, and any licence condition attached following the consideration of relevant representations must be necessary to achieve these four objectives.

Coun June Ashworth, cabinet member with responsibility for licensing, said: "The Licensing Act 2003 brought about fundamental changes to the regulations relating to the sale of alcohol and to the provision of regulated entertainment and late night refreshment.

"While our original Statement of Licensing Policy ensured that these changes were brought about smoothly, it was necessary to review the policy in line with legislative requirements.

"With the help of those in the licensed trade and various other people interested in the licensing of premises, along with the experience we have gained in the last three years, we have been able to produce a policy which will guide us through the next three years."
