Consultation on Addendum to Basic Conditions Statement to commence

The Examiner concluded that subject to the recommended modifications set out in the report , the modified Plan should proceed to Referendum and that this should be held within the Scotforth Neighbourhood Area. However, on 25 March 2026, the Government introduced a few changes through the Levelling Up and Regeneration Act 2023 (LURA), including Sections 98 and 99, which are relevant to neighbourhood planning. The Government did not introduce transitional arrangements for these provisions, meaning that they apply to all neighbourhood plans currently in progress. These changes were not addressed within the Examiner’s report due to the timing of the introduction of these changes.

As a result of these changes, the Scotforth Rural Neighbourhood Plan is affected by the updated legislative framework. This means that the Neighbourhood Plan is required to undertake additional work to demonstrate compliance with the amended legal requirements and change to the basic conditions introduced through Sections 98 and 99 of the 2003 Act before it can proceed further in the neighbourhood planning process. The District Council has therefore advised Scotforth Parish Council to produce an Addendum to their Basic Conditions Statement which sets out how these changes have been addressed.

The Council will now hold a further focused six-week consultation, inviting comments solely on the content of the Basic Conditions Statement Addendum The focused consultation will commence on 6 July and close on 17 August 2026. The Addendum, along with any comments that are received in response to the focused consultation, will be submitted to the Examiner, and the examination report will be re-opened to address these issues.
